Privacy Policy
AvSuite Pro is a service of Nicholl Aviation LLC (“AvSuite Pro,” “we,” “us,” or “our”). This Privacy Policy explains how AvSuite Pro collects, uses, discloses, stores, and protects personal information in connection with the AvSuite Pro website, applications, software, and related services (collectively, the “Services”).
1. Information We Collect
Account Information
We may collect name, email address, telephone number, username or account identifiers, organization affiliation, account role, authentication information, and account preferences.
Aviation and Training Information
AvSuite Pro may process student training records, instructor information, certificate and rating information, flight and ground training history, lesson completion information, aeronautical knowledge evaluations, risk-management evaluations, flight-skill evaluations, instructor comments and notes, training dates and durations, flight experience, aircraft associated with training, training curriculum information, endorsement-related information, and other aviation-training records entered by users.
Organization Information
We may process organization names, locations, administrators, instructors, students, aircraft information, training programs, scheduling information, subscription information, and organization preferences and settings.
Documents and Uploaded Content
Users may upload documents and files that contain personal or aviation-related information. Users and organizations should upload only information reasonably necessary for their use of AvSuite Pro.
Payment Information
Payments may be processed by third-party payment processors. AvSuite Pro may receive subscription status, transaction identifiers, billing contact information, payment status, and limited payment-method information. AvSuite Pro does not necessarily receive or store complete payment-card numbers.
Technical Information
We may automatically collect IP address, device type, browser type, operating system, login activity, features accessed, error and diagnostic information, security logs, and approximate location derived from an IP address.
2. Information Provided by Flight Schools and Organizations
AvSuite Pro often receives personal information because a flight school, instructor, employer, educational institution, or aviation organization uses AvSuite Pro to manage training. For example, a flight school may create a student account and enter training records. In these circumstances, the organization generally determines why the information is entered and how it is used within its environment. Questions about the accuracy or use of organization-controlled training records may need to be directed to that organization.
3. How We Use Information
AvSuite Pro may use personal information to provide and maintain the Services; create accounts; maintain aviation-training records; display training progress; allow instructors to evaluate students; manage organizations, instructors and students; provide scheduling and administrative functionality; process subscriptions and payments; authenticate users; protect accounts and systems; detect fraud, abuse, and unauthorized access; troubleshoot technical problems; provide customer support; improve and develop AvSuite Pro; communicate service-related information; comply with legal obligations; and enforce applicable agreements and policies.
4. How We Do Not Use Training Records
AvSuite Pro does not claim ownership of student or instructor training records merely because they are stored through the Services. AvSuite Pro does not sell individual student training records to advertisers and does not use student proficiency evaluations to make independent FAA certification decisions. AvSuite Pro does not issue pilot certificates, ratings, or FAA authorizations.
5. Legal Bases and Consent
Depending on the jurisdiction and circumstances, information may be processed to perform a contract, provide requested Services, pursue legitimate business interests, with consent, comply with legal obligations, or for other purposes permitted by applicable law. Where consent is legally required, users may have the right to withdraw it subject to applicable requirements.
6. How Information Is Shared
Within an Organization
Information may be accessible to authorized administrators, instructors, students, or other personnel within the organization associated with an account, depending on permissions and AvSuite Pro functionality.
Service Providers
We may use providers for cloud hosting, database infrastructure, authentication, payment processing, email delivery, analytics, security, error monitoring, and customer support. Providers may process information as necessary to perform services for AvSuite Pro subject to applicable agreements and law.
Legal Requirements
We may disclose information when reasonably necessary to comply with law or valid legal process, protect the rights or safety of AvSuite Pro or others, investigate fraud or security incidents, or enforce agreements.
Business Transactions
If AvSuite Pro is involved in a merger, acquisition, financing, restructuring, or sale of some or all of its business, information may be transferred as part of that transaction subject to applicable law.
7. Sale of Personal Information
AvSuite Pro does not sell personal information in the ordinary meaning of selling information for monetary payment. If practices change in a manner that creates additional rights under applicable privacy laws, this Policy will be updated and required choices will be provided.
8. Cookies and Similar Technologies
AvSuite Pro may use cookies, local storage, authentication tokens, and similar technologies to keep users signed in, maintain sessions, remember preferences, protect account security, measure application performance, and understand feature use. Some technologies are necessary for operation and security.
9. Data Retention
AvSuite Pro retains information for as long as reasonably necessary to provide the Services, fulfill contractual obligations, comply with legal requirements, resolve disputes, maintain security, and enforce agreements. Retention periods vary by information type and relationship. Organizations are responsible for their own regulatory and operational retention obligations. AvSuite Pro should not be considered the sole archival repository for records an organization is legally required to maintain.
10. Account Closure
After account closure, certain information may remain temporarily in backups, security records, transaction records, or other systems where retention is reasonably necessary. Information may also be retained where required by law or necessary to establish, exercise, or defend legal claims. Organizations should export records they must retain before closing an account when export functionality is available.
11. Data Security
AvSuite Pro uses reasonable administrative, technical, and organizational safeguards intended to protect personal information. Safeguards may include access controls, authentication mechanisms, encrypted communications, database security, logging, backups, and other practices appropriate to the Services. No system can guarantee absolute security. Users are responsible for protecting passwords, devices, and authentication credentials.
12. Data Breaches and Security Incidents
If AvSuite Pro becomes aware of a security incident involving personal information, we will investigate and respond as reasonably appropriate. Where required by law, AvSuite Pro will notify affected individuals, organizations, or governmental authorities.
13. Access, Correction, and Deletion
Depending on circumstances and applicable law, individuals may have rights to request access to personal information, correction, deletion, a copy of certain information, restriction of certain processing, or other privacy rights. When information is controlled by a flight school or other organization, AvSuite Pro may direct the individual to that organization or assist the organization in responding. Certain aviation-training or business records may need to be retained despite a deletion request where permitted or required by law. Requests may be submitted to support@avsuitepro.com.
14. Student Records
AvSuite Pro recognizes that aviation-training records may be important to a student’s certification and professional development. Organizations and instructors should maintain accurate records and appropriately restrict access. AvSuite Pro provides technology for maintaining such information but does not determine which records an organization is legally required to retain.
15. Educational Institutions and FERPA
Some organizations may be educational institutions subject to the Family Educational Rights and Privacy Act (“FERPA”) or similar requirements. AvSuite Pro does not represent that every customer or aviation-training record is subject to FERPA. Where AvSuite Pro enters an agreement with a covered educational institution, additional contractual requirements may apply. Educational institutions remain responsible for determining their own FERPA obligations.
16. Children’s Privacy
Flight training may involve individuals under 18. AvSuite Pro is not intended to be independently used by children under 13 without involvement or authorization from an appropriate parent, guardian, organization, or other legally authorized party. AvSuite Pro does not knowingly seek to collect personal information directly from children under 13 in violation of the Children’s Online Privacy Protection Act (“COPPA”). If we learn that information was collected from a child in violation of applicable law, we will take appropriate steps.
17. Third-Party Services
AvSuite Pro may integrate with third-party services or provide links to external websites. Those services have their own privacy policies and practices, and AvSuite Pro is not responsible for the privacy practices of independent third parties.
18. International Users
AvSuite Pro may be accessed outside the United States. Information may be processed and stored in the United States or other locations where AvSuite Pro or its providers operate. Where required, AvSuite Pro will use appropriate safeguards for international transfers of personal information.
19. Changes to This Privacy Policy
AvSuite Pro may update this Policy as the Services, technology, or legal requirements change. The “Last Updated” date will identify the current version, and material changes may receive additional notice when required by law.
20. Contact Us
Questions, privacy requests, requests for access or correction, or concerns regarding personal information may be submitted to support@avsuitepro.com.
